     มาตรา ๗๔๗ อันว่าจำนำนั้น คือ สัญญาซึ่งบุคคลคนหนึ่งเรียกว่า ผู้จำนำ ส่งมอบสังหาริมทรัพย์สิ่งหนึ่งให้แก่บุคคลอีกคนหนึ่งเรียกว่า ผู้รับจำนำ เพื่อเป็นประกันการชำระหนี้‎

     Section 747 As for pledge, it is a contract by which a person, called pledgor, delivers a specific movable property to another person, called pledgee, as security for the performance of an obligation.

     The term chamnong was formerly used together with the term chamnam and the two were synonymous. They have just been used according to the Civil and Commercial Code in our days.

     Section 750 When the pledged property is a right represented by an instrument, if such instrument has been not delivered to the pledgee and debtors of that right have not been notified in writing of the pledge as well, then the pledge is said to be void.
